Delhi High Court Stays Re-Election Of Members Of Standing Committee Of MCD

The Delhi High Court stayed the fresh re-election of the MCD standing committee on Saturday which was scheduled to be held on February 27, 2023. A notice has been issued to Delhi Lieutenant General Vijay Kumar Saxena, Delhi Mayor Shelly Oberoi, and the MCD.

On Friday, Delhi’s Mayor announced to hold of fresh elections on February 27, 2023 at 11 am after chaos at MCD House.

The scuffle took place between BJP and AAP when Mayor Shelly Oberoi declared one vote invalid in the election to six members of the Standing Committee.

Both BJP and AAP blamed each other for the violence.

BJP Councillor Meenakshi Sharma later filed a police complaint at Kamla Market police station against AAP Councillors for causing grievous harm and injury and committing criminal assault with women Councillors of BJP intending to outrage the modesty and giving threat of life with criminal conspiracy.

AAP members also reached the Kamla Market police station to file an FIR against BJP. They alleged an attempt of murder on AAP’s women councillor.

The bench of Justice Gaurang Kant stated that the Mayor’s decision to announce re-elections without declaring the results of the previous poll ‘prima facie violates regulations’. While staying the re-election for Standing Committee members, She also issued notice to all respondents including newly elected Delhi Mayor Shelly Oberoi.

The court also issued directions to preserve the ballot box.

The Delhi High Court fixed the matter for March 22, 2023.
