UP Municipal Corporation Polls: Supreme Court stays Allahabad HC order on OBC reservation issue

UP Municipal Corporation Polls: The matter was heard in the Supreme Court on Wednesday amid debate over reservation for Other Backward Classes (OBCs) in local body elections where the apex court has stayed the order of the Allahabad High Court.

UP Municipal Corporation Polls: The Supreme Court has stayed the order of the High Court to conduct the elections before January 31. The apex court has also issued a notice to the other party. Via notice, the Supreme Court seeks a reply within three weeks. The next hearing will be after three weeks. During the hearing, the UP government told the court that the Backward Classes Commission would submit its report by March 31, 2023.

The Yogi government of UP had filed an SLP (Special Leave Petition) in the Supreme Court following the decision of the Lucknow bench of the Allahabad High Court on the issue of OBC reservation over the state municipal elections.

The Lucknow bench of the Allahabad High Court, canceling the OBC reservation, had stated that according to the order of the Supreme Court, a commission should be formed to give OBC reservation, only upon the formation OBC reservation should be allowed. The court also said that the government should adopt the triple test formula. And this may take time, therefore, in such a situation, if the government and the Election Commission want, they can conduct elections immediately without OBC reservation.

After the verdict of the Supreme Court, CM Yogi tweeted that we welcome the order given by the Honorable Supreme Court regarding the urban body elections in Uttar Pradesh. While implementing OBC reservation within the time limit given by the Hon’ble Supreme Court, the Government of Uttar Pradesh will cooperate in conducting the civic body elections.

Within 24 hours of the decision of the Lucknow bench of the Allahabad High Court, the UP government had constituted a five-member committee.
